Federal Law No. 13,709/2018 - the General Personal Data Protection Law (GPDP) establishes rules for the protection of and respect for the processing of personal data of natural persons (individuals), with the aim of protecting the fundamental rights of freedom and privacy.

What is the purpose of the GPDP?

The law aims to protect the rights to freedom and privacy of personal data subjects.

What is personal data?

Information relating to an identified or identifiable natural person: Examples: ID, NIN, address, telephone number, e-mail address, financial information, affiliation, nationality, etc.

What is sensitive personal data?

Data on racial or ethnic origin, religious conviction, political opinion, membership of a trade union or religious, philosophical or political organization, data relating to health or sex life, genetic or biometric data, when linked to a natural person;

What are the rights of personal data subjects?

In accordance with Art. 18 of the GPDP, Montreal Montreal must respect the following rights of the holder of personal data and make them available upon request: 

                                     I.     Confirmation of the existence of processing; 

                                   II.     Access to data; 

                                III.     Correction of incomplete, inaccurate or outdated data; 

                               IV.     Anonymization, blocking or elimination of unnecessary, excessive data or processed in disagreement with the provisions of this Law; 

                                  V.     Portability of data to another service or product provider, upon express request, in accordance with the regulations of the national authority, observing commercial and industrial secrets;     

                               VI.     Deletion of personal data processed with the consent of the data subject, except in the cases provided for in section 7 (seven) of this document; 

                             VII.     Information on public and private entities with which the controller has shared data; 

                          VIII.     Information on the possibility of not providing consent and the consequences of refusing to do so; 

                                IX.     Revocation of consent.
